Family Courts Act 1984

i. Family Courts

The State Government, after consultation with the High Court and by notification shall establish a Family Court. However such courts shall be established only for a city or town whose population exceeds 1 million. The State Government with the concurrence of High Court may appoint one or more judge or judges of a Family Court and the Act lays down the provisions relating to terms of office, salary, allowance etc. of such judge/judges.

The State Government in consultation with the High Court may also provide for associations/welfare agencies to enable the Family Court to exercise its jurisdiction more effectively. It has to be noted that this provision is not mandatory. The use of word "may" indicates that it is the discretion of the State Government whether to provide for such associations or agencies or not.

The Act also authorizes the State Government to make provisions regarding the number and categories of counsellors, officers and other employees required to assist a Family Court and the terms and conditions of their service and employment.
